 Going bankrupt remotely from Canada

I have lived in Canada for over a year, but still have about 9Ks worth of debt outstanding in the UK, which I have little hope of ever clearing. Consequently, I am considering going bankrupt in the UK, using a service such as Myvesta.

Does anyone out there have any experience of declaring UK bankruptcy from Canada? Any insights on if and how it will effect my Canadian bank account, credit card etc? I have no debts or assets within Canada.

Any advice is greatly appreciated.

Hi Halo and welcome

I am not 100% sure on this one, but i wanted to say hang on in there and someone with a little more knowledge than i have on declaring bankruptcy abroad will be along soon.

No experience of Canada in particular, but some countries have a reciprocal arrangement with the UK so that assets in the other country may be at risk with a UK bankruptcy - probably best to get professional advice on which countries this includes.

Canadian banks are not allowed to cancel existing accounts or refuse to open new ones if you are bankrupt - apparently it's illegal for them to do so (according to bankruptcycanada.com).

There are several assisted bankruptcy companies in the UK who can help you file from abroad - some of them post here. Would definitely recommend Paul Johns @ RevivaUK both for advice and to handle things for you.

Would it be worth seeing if this new legislation coming in April regarding debt under 15,000 might make things easier?

Or is there no way you can pay it off?

Hope you are well!

I would recommend you speak to Paul Johns from Reviva UK - he is one of the Experts on this Forum and very friendly, helpful and knowledgeable - and they offer a Bankruptcy Assist Service which includes BR from overseas.

I am with Paul and am due to go BR tomorrow morning at 09:15am - aaaaarrrrggggghhhhh!!!! - and then I am going to Canada myself on 27th Jan. for 1 year. I can't wait!

Where in Canada are you?

Thanks all. I've emailed Reviva.

Can't say I'm familiar with the new legislation, but realistically there's no way I can pay it off anyway, unfortunately.

D&C - I'm in BC, Canada, and it's beautiful here.

Yes BC is where I am heading. It's a great place!

Well, my BR is done now - just got back from Court - was not too bad but glad that Paul Johns was there with me.
