Hi I really want some advice... I owed 30k and I am in an IVA I was told at the time by the IVA company that this was the best solution for me, as I work for the local authority in the community and they told me my name would be in the paper. I have no assests the house is my husbands before he met me and the debt is mine. My IVA is for 6 and a half years, I have been in the IVA for nearly 2 years. I have been ill with heart defect and would love to drop a days work but I can't afford to. I think I would like to go bankcrupt but nervous of this.... please help |

Hi Brightbay & Welcome
Sorry to hear about your health problems, i do symparthise with you over that and the fact the debts have got to you also which is probably not helping matters.
Have you paying into the house at all, like any bills etc as even though the house is in his name you would have to proove that you have not contributed towards the house when you were to go bankrupt.
If you decide that BR is your only way now, your name would appear in the paper and also on the insolvency site and you would have to miss a minimum of 3 payments to the IVA co so that a cert of failure could be issued. You would need this to take to court with you.
Bankruptcy is not bad as you may think, and on here we will give you the best advice possible to help and guide you. Always remember that your not alone there are many of us in the same boat so to speak.

Thank you for replying, the bit about the bills towards the house is difficult as when I went throught he IVA my wages get paid into my husbands bank account, therfore it gets swolled up towards paying some items ie my IVA £265.00 per month, but to be honest my husband earns a lot more than me and before my money went into his account I used to only pay for food shop and my own expenditure.... thing that gets me i owe 30k in 6 and a half years I would have paid nearly 20k back to the bank and on top of that 11k to clear start! which amounts to the 30k I owed the bank. When I was struggling with my loan and credit card I asked them to let me consolodate (that was the bank) they told me I couldn't until I was in the black for 3 months, I told them at the time it was impossible, that is why I went down IVA Still not sure what to do as the job I do involves working with vulnerable people and their carers and my name in the paper will probably result in disapline at work so I guess I have no chioce but to continue paying clear start |

yours a delicate situation. On the one hand you do not want to identify that you have income going into your husband's account which is ultimately put towards the mortgage or utilities as that will identify that you have an interest in the property which is an asset the OR will want to claim.
On the other hand if your husband is evidenced to be the sole contributor for all of these costs then you are undoubtedly looking at an IPA payment for 3 years.

you're most welcome.
You will most likely have to leave your name and a contact number when calling the helpline but they should be back to full strength tomorrow following the seasons festivities so someone will get back to you and talk you through.

My job involves working with vulnerable people and I have to be CRB cleared before I can start work anywhere. I've not had a problem with declaring bankruptcy and continuing to work so it shouldn't be a problem for you. |
