| HI my name daniel and I am looking into BR, could anybody help with what happens to unsecured creditors with or applying for charging orders on my property |

Welcome
All unsecured creditors would be written of as long as they are not down to fraud, some student loans and also fines.
The charging order how long before they apply it as if you go Bankrupt before the date it wont be applied.

Hi
an unsecured creditor seeking a charge on your property must have the final charge granted by the court before you declare bankruptcy.
If you get in first as it were then the charge cannot be authorised.

I wanted to add that it may be worth speaking to someone like our helpline so then you can go through your options with them, it is a big decision to make and to have someone on a one to one can help.

If you could give us some more details we could assist further.
1) Is there already an interim charging order on your property?
2) If so, how long is it before the court hearing to make it up to a full charge?
3) What is your total debt?
4) Is there equity in your property?
5) Is it solely owned or jointly owned?
6) Are there any other assets, e.g. car?
