Just received notification of my IPA, and wondered what happens with regard to commission/bonus.
I told the OR at my interview that my salary fluctuates, and he didn't seem too concerned, but it can be different every month, surely I don't have to advises them every time I receive a bit more, or a bit less in my pay packet.

It will depend on the amount of difference each month and also the OR. I've seen posts where some people have been told by their OR that so long as the commission/bonus is less than £100 they don't need to know but in other posts it looks like the OR is quite strict.

Did you mention the fluctuation during the OR interview? Did the OR say anything about it?

Yes, told him in interview, in fact drastic reduction in commission is one of key factors in my bankruptcy, and he didn't seem concerned.

I received back pay last month of £160 extra in my pay and I informed my OR, who said that as it was such a small amount and a "one off", then I would not need to declare it as it would cause more paperwork than it was worth. I'm also expecting my monthly pay to increase from 1st May by about £30 (wow!!) and I will let my OR know of this, but am hoping she will not bother with it as again, it is such a paltry amount.

In my experience 100% of any little extras have had to be paid straight over to OR!!!

In December i got a £225 bonus and when i informed the OR they told me i had to pay the full £225 over as it constituted an asset acquired after bankruptcy! It took me 2 months to get them to reduce the amount that they wanted me to pay to £170 after NI and tax deductions - which i felt was still too much but by that point was glad to pay it just to get it over with

I think that some OR's are much more strict than others, which i think is unfair - there should be clear guidelines on what needs to be declared and the levels/percentages that have to be paid, that all OR have to stick to and so that people like us know where we stand!

I agree with you, Tifosi1, that there should be clearer guidelines as some OR's seem more lenient than others. I always thought that any 'extra' earnings of substantial amounts were calculated on a percentage system if the amount is more than £100. I think that depending on the amount though, most OR's would not want to be bothered with the extra paperwork involved in the amounts are too minimal to be worth the hassle. I suppose I should be grateful my annual pay increases are so small after all.lol.

Maybe the attitude of my OR will change over time, but so far, I think she's been very reasonable about things. Hopefully this will continue for the next 3 years.

Hi

I understand the sentiment as when facing bankruptcy it would be nice to know exactly where we stand beforehand.

However, I suspect if the Insolvency Service drew up a procedure that ALL OR offices must abide by, and remove any flexibility, most bankrupts would suffer more as a result.

Yes you have a point, John. Personally I think the current way in which OR's operate is probably the best and although there is no clear cut guidelines, the OR's do have to abide by the insolvency guidelines on what and what isn't available for I&E and the current way they operate allows them to be flexible to a degree. I would have certainly lost my car if the OR rigidly abided by the guidelines. As it was, I was allowed to keep it for a payment of £100, which is better than losing it in the end as it isn't required for essential purposes such as work.

To keep you posted, I wrote to OR regarding bonus/commission payments, and just received letter back confirming they are aware my income can fluctuate, but my payments will remain the same for 36 months, and just to inform them if it changes drastically.
Wonderful news, so relieved.
