My husband and I are due in court at the end of June to file for bankruptcy. We were both made redundant at the beginning of the year and have about £23,000 of unsecured debt, a mortgage of £139,000 with a secured loan of £23,000 on the property. We have braced ourselves for the inevitable loss of our home but are unsure about how to go about getting a rented flat. We have spoken to local council who say that because we have no dependent children ( we are aged 53 & 52 ) it is unlikely that we would be offered accommodation. As we are both claiming jobseekers allowance at the moment it seems unlikely that a private landlord would consider us, even worse once we have been made bankrupt. We would be grateful if you could give us some advice on this. we are at our wits end and can see no end to our problems at the moment, the biggest one being where will we go and should we go now or once we have the eviction order, thanks |

Hi,
Welcome to the forum. As you say it looks likely that you will lose the house as part of your BR but that doesn't mean that you can't rent privately. Private landlords will be ok with you both claiming job seekers allowance as long as it covers the rent.
I would start looking for rented accommodation now as it could take a couple of months to find something. There is a thread on getting rented accommodation when BR a couple of posts below this one and there should be some useful information there. |

Just wanted to add that whilst its a little harder to find accomodation whilst your bankrupt its not impossible. It may be worth looking around at the private sector as some private landlords are more likely to take you on rather than those that are advertised via a lettings agency. Your local authority may even be able to help once you get a date for repossesion but look around now and find out everything you are able to so that it does not become a stressful addition to what is already a trying time.

Hi Thank you so much, its certainly good to know there's a place to come for some friendly non-judgmental advice.
We will certainly start to investigate the possibility of a private landlord, do you think we should warn any landlords that we're about to become BR? and if we were lucky enough to find accommodation before we get the eviction order do you think we should move out of the house and hand the keys back or wait till the bitter end? we're wondering whether we would still be entitled to housing benefit due to the fact that we would of made the first move ourselves, and maybe it could be seen as making ourselves homeless. Thanks

These are all things that need carefull consideration and thought. You need to look down every avenue and see what help is on offer for you. I know of others who have found rented after going bankrupt, there is even talk of help for homeowners but again its something to look into. The only way to really find out is to ask around, call your local JSA office, the council and also maybe CAB, get local papers look for private landlords and find out what criteria they are asking for. Take it one step at a time and make sure you do thinks in an order that suits you best.

Yes, you should mention to the landlord that you are going to be BR. It's always best to be open about these things and depending upon the rental agreement the OR may need to tell the landlord that you are BR.
I am not too sure whether you would be entitled to housing benefit if you were to move out before being evicted but I am sure an expert will post a message either today or tomorrow in this thread. |

I am of th opinion that regardless of age the local council has a duty to rehome you if you are evicted. If so it would be worthwhile to wait in your home until evicted by the mortgage co
