thank you. i moved out and found somewhere else to rent. yet i still had possessions in the property, furniture etc. he has since written to my new address asking for one months rent and part of another. i havent replied to his letter. he became a bully when the council made an order for works to be done on the house as it was against having a tenant in there. i just had enough and moved out. i am renting somewhere else now. reading about ORs taking cars, what if you dont tell them you have a car? ok..i kno you will say they should be told. but i have to have my car for my back and neck injury to get about. iv still got the bankruptcy forms which i now feel i will fill out. can one close accounts before handing in the form so you dont have to inform of the accounts as they would already have been closed?

how do i apply for a debt relief order? where do i go to do this? will my ccj of £7,500 be included in a debt relief order? thanks for all your help. but please would love to find out more about this debt relief order. iv checked the page out but wonder how to do it. thanks

sorry..me again. whats the difference with doing a debt relief order? im on a low income so would qualify. debts have to be £15,000 and under? how about the ccj for unpaid school fees? would that be taken on that too? iv got to do something soon. iv got the br forms. but if debt relief order is better, than il go for that but want to know pros and cons. thank you so so much for such real advice

You can apply for a DRO either from a CAB or via a company called Baines and Ernst.
I think your CCJ would be included, so if this takes you over the £15,000 mark then you wouldn't qualify.
If this happens and you have no assets, then I would look at BR.

If they let you keep your car then they require you to show it has up to date insurance, tax etc. Your postings are soming across as very panicky, I think it would be a good idea of you made an appointment at the CAB office & go through all your options calmly. Even if you go bankrupt it won't solve all your problems, you will need to learn to budget your money, not run away from your bills. And it could get you in a lot of trouble if you lie about not owning a vehicle, & they may well then look at all your financial dealings with a fine tooth comb. |

I agree with RHB. If you do go bankrupt then you need to be totally honest with the OR as they will find out if you have hidden anything and you could end up with a Bankruptcy Restriction Order which effictively means that your BR goes on for longer than 12 months.

The OR will automatically check with the DVLA if you own a vehicle. If you can provide a letter from your Dr. saying that a car is a necessity for your health then you may have a better chance with keeping it.
I agree with RHB and Kallis please get some free impartial advice from someone like National Debtline, CCCS and the CAB. |

thank you. i think br is the best thing as they all come to over 15,000pounds. no..i wont lie. my car has no mot. i havnt mot'd it cos i thought if i did they could then look on it as saleable and take it. if i want to keep it and get my doctor to give me a letter, is it best for the car to be shown as mot'd and being used? i just didnt want to pay out for mot and repairs and find they take it anyway. so thought if i left it without mot and said i need it and it will be repaired by friend etc, if they say ok keep it, then id get it done. what is best? opened more letters iv kept unopened and found more i owe, felt panicky and then when i thought of filling in the br forms and going ahead with it, i started feeling a calm i hav not felt in a long time. spent time thinking about it and what i would lose eg close bank accounts but then what i would gain was so much better. i have a prepay card now. its so brilliant. i can still open a cash card account. and all iv thought id lose just doesnt feel signifcant to me any more to gain peace of mind and start a new life where i learn to live within my means and budget better. i just want it all to end and br just is the only way that i will start to feel peace in my life and stop being scared of the postman in the morning and keep moving every year to escape bills which always find you. i just want to stop hiding and live at peace and every time i think of br i feel a sense of calm wash over me. i look on it as a new start. i want this new start so much that yes i will give the OR everything and not hide anything.

havnt looked thro forms properly tho started filling them. do you declare accounts you have open or do you also have to declare any you closed recently? or do you not put them down as say youve just closed them. and so not mention on the forms? not sure if forms ask of uv closed any recently. becos if they closed why mention?

If your car hasn't got an MOT then it isn't essential to you unless you've been driving around without it? The OR will get money for the car with or without an MOT. |

iv had help from using someone else's car. i will leave it without mot. the back is badly dented in and hasnt been repaired. i wil leave it and if given a price, i hope i can get someone to offer to buy it back for me. hopefully with the condition it's in at a much lower price. if not..i have been offered a car to use which i was going to put in my name but i will leave it in the person's name. il try fill the forms and go in next week or the week after. iv closed a couple of bank accounts..i never was using anyway and had nothing in them. just left with the one iv got the big overdraft on that i cant pay off. worried that il be asked questions i cant answer on that as silly me mainly allowed an ex partner to use it and so many payments off there, i dont know anything about. we're not together now but worred il be asked what things are for and payments etc and i wont be able to answer as i just made the payments when asked as he put the money in there. he couldnt get an account you see. im so worried that i wont be able to give them any answers on that account. any advice on this please. thanks

thanks paul. made it all so clearer specially the advice on the car which i could keep. still panicky to do this on my own. so ready when you are. opened more letters and found debts have been sold on. i just want to do this and get it done and over with and get on with my life afresh a new start. didnt realise it topped 20grand! feeling much calmer now cos im going to go for bankruptcy. im looking forward to it. new start. il sleep at night. il stop having panicky attacks worrying that bailiffs will start cos iv gone through that before and its really a very bad thing to go through. il be in touch this week or you ring me so we can get this done. thanks paul it all seemed so much clearer and there was life shining at the end of the tunnel after chatting with you. speak soon :-) x
