HI,
I recieved a bank error and was paid 19.5k in the bank.
Im going to court over it soon and is costing me a lot of money, if i went bankrupt would i have to pay them back or not?

I was paid 11k into my bank I returned it as it wasn't my money'if you have been paid by error then it wasn't your money in the first place to spend!! If you do go bankrupt i think you might get bru/bro as you knew this wasn't your money to have

Were you not aware that this money was an error? I'm sure I would know if something was paid in which wasn't owed to me!
Not sure what would happen if you went BR and you knew this, and it would appear that you did.

I nearly had a heart attack when i saw 11k must admit first thought was a crysler but knew it wasn't mine when i went to the bank they were very grateful if only they rembered that when i missed a DD !! |

I DO receive 20p every fortnight from the DWP - it is my Employment & Support Allowance - as I have a small pension!!
It is better than 10p I suppose

If it were not serious, it would actually be serious...
I have questioned the economics of paying that sum into my bank every two weeks and also questioned the assessment... that was 3 letters and 8 weeks ago - the last time I spoke to someone at the DWP about it they said, "I cannot stay on the phone all day talking to you..."

To the OP,
If you declared BR then you wouldn't have to pay it back but you would more than likely be subject to a BRO (Bankruptcy Restrictions Order). This would mean that, although you would be discharged from BR after 12 months, the BR restrictions (not being able to be a Director of a company, being obliged to tell creditors if you wished to borrow more than £500, etc.) could apply for up to 16 yrs.
My advice would be to talk to the bank and try to work out some type of repayment plan before it goes to court and you (possibly) incur the court costs. You could also mention to the bank that if you did end up going to court your only option would be to declare BR. |

I think the OP would have known that the money wasn't theirs in the first place.
If you did spend that money knowing that it wasn't yours, then that is theft.

I agree with Kallis . . it seems the original poster knows this was an error and (in my opinion only) is prepared to go br to avoid paying it back.
This does give genuine people a very bad name. Please re-consider and come to an arrangement with your bank. |

Couldn't agree more - if someone had paid that money into my account I would be straight on to the bank to sort it out.

A while back there was a doctor who posted on the forum. He changed jobs within the same nhs trust and was paid his new salary in addition to receiving his old one in error.
As is was clearly an error and was not an oversight ( i.e. a few hundred pounds he was subject to a BRO. His employer also took civil action against him.
