Hi All
I just wanted to post as i am so happy that we have now had the letter from the OR to say that the House is in Neg Equity and that we can buy it back for £211 plus £1 each, so £213 total.
Took 3 weeks to get this and the cheque will go off Monday.

I miss this place too but i had to get a few things sorted out plus there are lots of new experts and other chnages going on with the site now, its so different to how it used to be.
I see you can now pay a fee for the form filling in on here, thats all new, but i would suggest to anyone considering doing that to shop around as anyone can fill in the form make sure you get your monies worth even if it is only £350.

Good advice in my opinion from needafriend! I'm no rocket scientist but I didn't think the forms were too bad at all. I took my time, read LOTS of info and helpful advice from this site and others and muddled through.
The examiner was obviously OK with the forms as I did them as I had no queries at all and everything went fine.
£350 is a lot of money when the whole reason for going BR is your financial situation. It is hard enough having to find the fees for filing for BR!.
Think hard before using a service like this. IF you do make an error on the forms, your examiner will understand and help to sort it out. I found them really helpful.
Then again, I suppose if you have a REALLY complicated case it may be worth the money if you have it for the help. But if this is the case I doubt very much if it will stop at £350.

Just to add a small point here - the forms have been designed to be completed by the individual and although may seem daunting when they arrive, if you sit down and read through them,you will see that they are not really that difficult for your basic 'household debt bankruptcy' - different if someone has been trading as things are slightly more complex. If you are in need of help and find the fee difficult to find which no doubt a lot of people do or they would not be contenplating filing for bankruptcy in the first place - your local Citizens Advice Bureau will complete the forms for you

And of course you don't have to fill them in all at once. If you take your time, and keep checking what you have filled in, then you should be ok.
I agree with Melanie that you should try the CAB who will help you for free.

I found it easier to complete the forms online as you can save them and go back and edit them if necessary.
Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.

For anyone considering buying the BI in there home all i did was the following and it did not cost a penny.
I contacted a local estate agent and asked for a quick sale valuation, which they did for free.
I then went into Zoopla to start with there figure was way out so i contacted them and told them the value that i had from the estate agent and they updated the info, then i found another site and got 3 valuations for same type of property within my postcode area and through 3 different estate agents and printed that off, i also had an up to date mortgage statement which i had to send off to the OR.
Originally in Sept we said we would not buy the BI but in Jan i called them and they resent the MP1 letter re the offer and it was returned along with above info on the 13th Jan.
It has cost me a few phone calls, printer paper and ink and a first class stamp, nothing more.

I waited till Jan to see what the market was like as i had no idea what would actually happen, luckily for us in 9 months the house had dropped by about 18-20k which has made a huge difference.
I know i had the debts and had to go BR but i wanted to fight for our home, which we have and apart from its over 6 months now since we went BR and that i dont have the other debts i feel that i have won a big battle. I dont care if we dont get an ED for me i have to do the time now as i had the money and tried to pay it back but circumstances meant that was not possible. I am happy to have secured my kids home now thats the main thing.
I did the bankruptcy on my own, all the form filling in on my own and when i approached the CAB for me they were as helpful as a choclate fireguard, i knew more about it than they did. Hence i wont ever go to them for advice, bare in mind thats only my experience and not everyone has the same.
You have to do whats right for you at the end of the day, we can all give advice and you take on board what you want to but its down to that individual in the end to how they proceed and then deal with things.
I would love to help you with yours, maybe admin can do an exchange of email addy and we can chat sometime.

when i went br in sept i had equity still have after last valuation will wait another 12 months at least i think we do have upto 3years if my thoughts on this is correct and yes if admin can give you my email thats fine by me take care |

My CAB said they don't help with forms anymore. Not enough funding or something. Don't know how true that is.
Needafriend - I Think you'll also find you had a result re. the valuation side of things. OR offices vary GREATLY. Most will want a Chartered Surveyor's report or 3 written estate agent's valuations regarding YOUR property. Failing this they will do a drive-by. They may do this anyway.
Different cases will vary from area to area. Be sure and be careful you do the right thing for you if it's important you keep your home.

I too found the CAB completely useless - they say they help with the forms, but when i went in there they didnt know how to fill certain sections out. And they told me i was going to loose my home (hubby is just buying bi) etc etc...they terrified me. Im sure they have great advisors and are good for certain situation, but certainly NOT bankruptcy advice. A quick call to the helpline sorted me out, and without this site i really would not know half of what i do.
Jo - Im so please you have finally got this last hurdle to go, and apologies for missing your call (was at hospital with mother in law). Keep us informed of your progress with it.
Hubby's cheque has come out for the BI, so its just a case of sitting and waiting now.

The house did have a drive by valuation doen by the OR as they WOULD NOT TAKE MY WORD FOR IT, the stuff i sent was so they could see that the value had dropped, then i had to wait for the report that the OR would have got.
I had previously sent 3 seperate estate agent valuations in Sept last year so this just followed on. |

No problem re the missed call, i will catch up with you over the next week.

I also found the helpline very helpful, John is an asset and without him i doubt i would have got through the last few months.
He is def a people person and thats what you need, someone who has been through it giving advice as they understand more.
I hope that John can still be contacted via the helpline as he made the helpline what it is, always there for us all no matter what time he would call us back.
The free advice is invaluable and so is the hand holding that comes along side, you dont get this at the CCCS or the CAB as they are mainly on the creditors side, we will all find our way of getting the advice we need regardless of where we get it, at the end of the day its all personal choice and what we feel is right for us.
There are many places out there that feel like they are bullying you into something that at the time seems right but then you fall foul to it, i know that now and i am glad i did my own and was refused an IVA but i did do my own DMP which i managed for 18 months then decided to make myself BR.
So by taking the bull by the horns and understanding the small print you can make your life so much better.
Remember this is only MY OPINION.
